Arbitration/Class Action Waiver

("JAMS"), pursuant to the JAMS Streamlined Arbitration Rules & Procedures, and conducted by a single, neutral arbitrator.

By using and/or accessing the Website, you agree that this constitutes a valid and enforceable written agreement to arbitrate under the Federal Arbitration Act, and that any dispute concerning this arbitration provision, including any such dispute as to the validity or enforceability of this provision, or whether a dispute or claim is arbitrable, shall be determined exclusively by the arbitrator selected by JAMS. If JAMS is unable or unwilling to arbitrate the Dispute, then the Dispute may be referred to any other arbitration organization or arbitrator the parties both agree upon in writing.

To start an arbitration proceeding, you must execute and serve a Demand for Arbitration on Epic Golf Club by mailing it to 8701 E Hartford Drive, Suite 135, Scottsdale, AZ 85255, pursuant to the JAMS instructions. Arbitration shall take place by phone, unless an in-person hearing is requested either by you or Epic Golf Club. In that case, the hearing shall take place in the county where you reside.

Neither you nor Epic Golf Club will be able to have a court or jury trial, or participate in a class action or class arbitration. Other rights that you or Epic Golf Club would have if you or Epic Golf Club went to court will not be available or will be more limited in arbitration, including the right to appeal.

YOU AND EPIC GOLF CLUB ARE EACH WAIVING THE RIGHT TO A COURT OR JURY TRIAL. ALL DISPUTES SHALL BE ARBITRATED ON AN INDIVIDUAL BASIS, AND NOT AS A CLASS ACTION, CLASS ARBITRATION, CONSOLIDATED, REPRESENTATIVE ACTION, OR ANY SIMILAR PROCEEDING.
